On November 2, 2007, Pearson, Simon, Soter, Warshaw & Penny, LLP and the Law Office of Wayne Beaudoin filed a class action lawsuit against Blue Haven National Management, Inc., and Golden State Industries, Inc. ("Blue Haven").
The complaint alleges that Blue Haven has and is deceiving the general public into believing that they are contracting with a long-standing company that has been in business for over 50 years, which has been widely accepted as a trusted company that has been the choice of hundreds of thousands of consumers. The complaint further alleges that the truth is that there has never been any single company operating under the name "Blue Haven" in the state of California since 1954 and that none of the companies operating under the name "Blue Haven" have been in business since 1954, are not "national" companies and do not have 250,000 satisfied customers coast to coast.
Therefore, as alleged in the complaint, Blue Haven's representations that the consumer was contracting with an experienced, reputable, dependable and long-standing company were false and/or misleading. The complaint further alleges that Blue Haven licenses its brand name to pool contractors without requiring them to construct pools to minimum standards. The complaint seeks class action status and damages to those California residents who purchased a Blue Haven pool.
