On March 15, 2005, Pearson, Simon, Soter, Warshaw & Penny LLP ("PSSWP") attorneys brought a class action lawsuit against Best Buy Co, Inc., America Online, Inc., and Time Warner, Inc. alleging violations of California's consumer protection laws. The lawsuit alleges that Plaintiffs were enrolled in AOL internet service without permission during purchase transactions at Best Buy retail stores. Plaintiffs also allege they have incurred unauthorized charges to their credit card, which have not been reimbursed by Defendants. PSSWP filed this lawsuit on behalf of all California residents who have been harmed by Best Buy's promotion of AOL internet service. The complaint seeks damages, restitution, and injunctive relief on behalf of Plaintiffs.
