Pearson, Simon, Soter, Warshaw & Penny LLP ("PSSWP") attorneys are currently pursuing an antitrust class action in the Northern District of California against several manufacturers of Flash Memory devices. The lawsuit alleges that Flash Memory manufacturers-including Samsung Electronics, Hitachi, Mitsubishi Electric, Micron Technology, and Toshiba - have conspired, combined, and contracted to raise and fix Flash Memory Drives at artificially inflated levels. PSSWP's class action complaint alleges that Defendants, who controlled more than 96% of the Flash Memory market during the class period, have damaged consumers by conspiring and colluding to fix Flash Memory prices at artificially high levels. The lawsuit is filed on behalf of all direct purchasers of Flash Memory in the United States and alleges that Defendants have violated federal antitrust laws.
UPDATE: On October 30, 2007, United States District Court Judge Saundra Brown Armstrong appointed Pearson, Simon, Soter, Warshaw & Penny, LLP as interim co-lead counsel for all direct purchaser plaintiffs in the coordinated antitrust class actions against the makers of flash memory products. Plaintiffs allege that between 1999 and the present, defendants engaged in a conspiracy to fix the prices of flash memory products sold in the United States. Pearson, Simon, Soter, Warshaw & Penny, LLP was selected from a group of distinguished antitrust firms who applied for the position. As interim co-lead counsel, Pearson, Simon, Soter, Warshaw & Penny, LLP will be responsible for supervising the direct purchaser plaintiffs' prosecution of the case and coordinating their efforts with the Department of Justice's ongoing criminal investigation.
