Pearson, Simon, Soter, Warshaw & Penny LLP ("PSSWP") represents plaintiffs in a class action lawsuit against Hewlett-Packard Company ("HP")-one of the worlds foremost manufacturers of inkjet printers and computer technology. The lawsuit alleges that certain HP inkjet printers and/or cartridges have been equipped with a "smart chip" that prematurely alerts consumers that the printer cartridge is out-of-ink or low-on-ink. HP's "smart chip" technology thereby forced consumers to prematurely purchase unnecessary replacement printer cartridges and has deprived consumers of the opportunity to obtain the full value of their HP cartridges. Plaintiffs allege that HP's conducts amounts to a breach of warranty, unjust enrichment, violation of California's Consumer Legal Remedies Act (Civ. Code § 1750 et seq.), and violation California's Unfair Competition Law (Cal. Bus. & Prof. Code § 17200 et seq.). This class action is pending in the Northern District of California on behalf of all individuals and entities in the United States who purchased HP inkjet cartridge containing technology that prematurely registers ink as being low or shuts down the cartridge.
