Moore v. C.A.R. Enterprises Inc.

Pearson, Simon, Soter, Warshaw & Penny LLP ("PSSWP") attorneys have filed a wage and hour class action on behalf of the employees of C.A.R. Enterprises Inc.-the owner's of approximately sixty mini-markets in the State of California. The lawsuit alleges that C.A.R. Enterprises violated numerous California statutes by:

  1. failing to provide employees with mandatory meal and rest breaks;
  2. deducting wages from employees for cash shortages, equipment breakage, or equipment loss that were not caused the employees willful or dishonest acts, or gross negligence; and
  3. threatening employees with arrest, prosecution, or imprisonment if they failed or refused to pay defendants for claimed cash shortages, equipment breakage, or equipment loss.

The lawsuit has been filed on behalf of all C.A.R. Enterprise employees who have been subjected to the above described conduct and alleges that Defendants' conduct amounted to civil extortion and violates California Labor Code §§ 226.7 and 512, Industrial Welfare Commission Wage Order 7-2001, and California's Unfair Competition Law (Cal. Bus. & Prof. Code § 17200 et seq.).
