Pearson, Simon, Soter, Warshaw & Penny, LLP ("PSSWP") represents consumers in a class action related to Apple, Inc.'s first generation iPod Nano. Plaintiffs allege that first generation iPod Nanos are defective because normal and ordinary use will result in the product becoming excessively scratched. They also allege that Apple, Inc.'s marketing of the product was unfair and misleading because it failed to advise consumers of this defect. The case is currently pending in Los Angeles Superior Court.
